Peter Driessel Photography: Terms and Conditions

These Terms and Conditions constitute a legally binding agreement between the client (“you”) and Peter Driessel Photography (“we,” “us,” or “our”). By booking and attending a photography session, using our website, or engaging with our services, you acknowledge that you have read, understood, and agree to be bound by the terms set forth below.
1. Introduction These Terms apply to your use of this website and to any transactions related to our products or services. Additional written agreements (such as contracts or booking forms) may also apply. In the event of a conflict, those additional contracts will prevail.
2. Binding Nature of Use By accessing or using our website and services, you confirm your acceptance of these Terms and Conditions. In some instances, you may be required to expressly agree to them.
3. Electronic Communication By communicating with us electronically (via email or website forms), you agree to receive communications from us electronically and acknowledge that such communications satisfy any legal requirement for written communication.
4. Intellectual Property All content on this website, including but not limited to text, graphics, logos, and images, is the intellectual property of Peter Driessel Photography or its licensors.
4.1 All Rights Reserved: No rights are granted to you unless expressly stated. You may not copy, distribute, monetise, reverse engineer, or modify any material without written permission.
5. Newsletter Forwarding You may forward our newsletter in digital format to interested individuals. Commercial redistribution is prohibited.
6. Third-party Websites and Services Our site may contain links to external websites. We do not monitor their content and are not responsible for their practices, policies, or damages arising from your use.
7. Responsible Use You agree to use this website and our services in compliance with the law and refrain from damaging, interfering with, or misusing the website or its content.
8. Submissions and Intellectual Property Sharing Unsolicited submissions will be considered non-confidential and grant us a non-exclusive, worldwide, royalty-free licence to use, adapt, or distribute the content.
9. Termination of Access We may terminate or suspend your access at any time without liability. You will not be entitled to compensation for lost content or services.
10. Booking and Deposits 10.1 A 50% non-refundable deposit is required to confirm your session. 10.2 Balance is payable on or before the day of the session.
11. Cancellations and Rescheduling 11.1 Cancellations within 7 calendar days will incur the full session fee. 11.2 You may reschedule twice within 12 months with at least 7 days’ notice. A R1,000 fee applies for short-notice changes.
12. Services and Packages 12.1 Services are rendered per the package booked, as described at www.peterdriesselphotography.com. 12.2 Products (prints, albums, files) are only included where specified.
13. Conduct During Sessions 13.1 No other photographers or recording devices may be used without prior consent. 13.2 Disruptive behaviour may result in immediate termination of the session.
14. Copyright and Usage Rights 14.1 All images are the sole property of Peter Driessel Photography. 14.2 Clients receive a non-exclusive, non-transferable personal-use licence. 14.3 Commercial use, reproduction, or publication without written consent is prohibited.
15. Unauthorised Use 15.1 Unauthorised image use incurs a R1,000 per image penalty and may revoke image rights.
16. Model Release and Promotional Use 16.1 Promotional use requires a signed model release. 16.2 In cases of non-payment, promotional use is deemed permitted for value recovery.
17. Editing and Delivery 17.1 All edits follow our signature artistic style. 17.2 Editing requests must be made before the session. 17.3 Final delivery is within 14 to 21 working days. 17.4 Unpurchased galleries may be deleted after 30 days; other files are stored for up to 12 months.
18. Product Orders 18.1 Products must be paid in full before production. 18.2 All custom orders are final and non-refundable.
19. Age Requirements 19.1 Boudoir or nude photography requires clients to be 18 or older. 19.2 Proof of ID may be requested.
20. Limitation of Liability 20.1 We are not liable for injuries, property damage, natural disasters, or equipment failure. 20.2 Maximum liability is limited to the total session amount paid.
21. Force Majeure 21.1 We are not liable for performance delays due to unforeseen circumstances.
22. Indemnity 22.1 You agree to indemnify and hold harmless Peter Driessel Photography against all claims arising from your use of the website or services.
23. Breach of Terms 23.1 Violation of these terms may result in legal action or site access termination.
24. POPIA and Privacy 24.1 We comply with the Protection of Personal Information Act (POPIA). For full data practices, see our Privacy Policy.
25. Export and Legal Restrictions 25.1 Access to this site from regions with legal restrictions is prohibited. You may not use our content in violation of South African export laws.
26. Affiliate Disclosure 26.1 We may earn from affiliate marketing or sponsored content. This will be clearly disclosed where applicable.
27. Assignment of Rights 27.1 You may not assign or transfer your rights under these terms without written consent.
28. Entire Agreement and Updates 28.1 These Terms, together with our Cookie and Privacy Policies, form the full agreement. 28.2 Updates to these terms will be published on our site. Continued use after updates constitutes acceptance.
29. Jurisdiction 29.1 This agreement is governed by South African law. Disputes shall fall under South African court jurisdiction.
